These Terms of Service ("Terms") are a binding agreement between you and HomeschoolOS, LLC ("HomeschoolOS," "we," "us," or "our") governing your access to and use of our website, mobile application, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

HomeschoolOS, LLC is a homeschool management platform that helps homeschooling families organize scheduling, track compliance and record-keeping requirements, manage curricula, and record grades and transcripts.

2. Eligibility and Account Registration

The Service is intended for use by adults — parents, legal guardians, and other adults responsible for a student's education — on behalf of the students in their household. You must be at least 18 years old and capable of forming a binding contract to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

Student profiles. Any student profile you create is entered and managed by you, the Account Holder. By creating a student profile, you represent that you are the parent, legal guardian, or otherwise have the legal authority to manage educational records on behalf of that student. See our Privacy Policy for how Student Data is collected and used.

3. The Service

HomeschoolOS provides tools for scheduling, curriculum tracking, compliance and attendance record-keeping, grading, and transcript generation. Features, tools, and availability may change, and we may add, modify, or discontinue features at our discretion, with reasonable notice for material reductions in functionality for paid subscribers.

Not legal, educational, or compliance advice. HomeschoolOS provides organizational tools to help you track your own state's homeschool requirements as you understand and configure them. We do not guarantee that using the Service satisfies any particular state's legal, reporting, or compliance requirements for homeschooling. You are solely responsible for confirming and meeting your applicable legal obligations.

4. Free Trial, Subscriptions, and Billing

Free trial. We offer a 14-day free trial. A valid payment card is required to start your trial.

Automatic conversion to paid subscription. Unless you cancel before the trial ends, your payment method will be automatically charged for the subscription plan you selected (monthly or annual) when the trial period expires. We will send a reminder notice at least one day before your trial ends.

Billing. Subscription fees are billed in advance on a recurring basis (monthly or annual, depending on your plan) and are processed through our payment processor, Stripe. By providing a payment method, you authorize us (via Stripe) to charge that payment method for all fees incurred.

Cancellation. You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period; we do not provide partial-period refunds except as required by law or as we otherwise state at the time of purchase.

Price changes. We may change subscription pricing prospectively. We will provide advance notice before any price change applies to your subscription renewal.

Failed payments. If a payment fails, we may suspend or limit access to the Service until the outstanding balance is resolved.

5. Your Content and Data

Ownership. As between you and HomeschoolOS, you retain all rights to the information, records, and content you input into the Service, including Student Data, curriculum selections, grades, and transcripts ("Your Content").

License to us. You grant HomeschoolOS a limited, non-exclusive, worldwide license to host, store, process, and display Your Content solely as necessary to provide and improve the Service to you.

Your responsibility. You are solely responsible for the accuracy of Your Content, including grades, attendance, and transcript information. Documents generated by the Service (e.g., transcripts) reflect the data you entered and are only as accurate as that data.

Deletion. You may request deletion of your account as described in our Privacy Policy.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;

• Impersonate any person or misrepresent your affiliation with a person or entity;

• Upload content that infringes the intellectual property or privacy rights of others;

• Attempt to gain unauthorized access to the Service, other accounts, or our systems;

• Interfere with or disrupt the integrity or performance of the Service (including through malware, scraping, or excessive automated requests);

• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where applicable law permits; or

• Use the Service to store or transmit content involving the exploitation or endangerment of a minor, or any other unlawful content.

We may suspend or terminate accounts that violate this section.

7. Intellectual Property

The Service, including its software, design, text, graphics, and trademarks (excluding Your Content), is owned by HomeschoolOS or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you to use the Service, we reserve all rights, title, and interest in the Service.

8. Third-Party Services

The Service integrates with third-party providers, including Stripe (payment processing) and Resend (transactional email delivery). Your use of features involving these providers may also be subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL SATISFY ANY PARTICULAR STATE'S HOMESCHOOL LEGAL OR REPORTING REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMESCHOOLOS, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless HomeschoolOS, LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or unlawful activity, or fail to pay applicable fees, with notice where reasonably practicable. Upon termination, your right to use the Service ends; provisions of these Terms that by their nature should survive (e.g., Sections 5 [as to accrued rights], 7, 9, 10, 11, and 13) will survive.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeschoolOS regarding the Service.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.

Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
